RELEASE & INDEMNITY In consideration for being permitted to participate in the Road Race organized and administered by Palm Springs Art Museum, I hereby waive, release and discharge any and all claims for damages, for personal injury, death or property damage which I may have, or which hereafter accrue to me, my representatives, agents, assigns and heirs, against Palm Springs Art Museum as a result of my participation in the Road Race and/or my usage and enjoyment of prizes awarded in the Road Race. This release is intended to discharge Palm Springs Art Museum, its respective affiliates, and subsidiaries, employees, agents, officers and directors, and successors and assigns from and against any and all liability arising out of or connected in any way with my participation in the activity, even though that liability may arise out of the negligence or carelessness on the part of the persons or entities mentioned above. I further understand that accidents and injuries can arise out of the Road Race or during usage and enjoyment of the prizes of the Road Race. Nevertheless, I hereby agree to assume those risks and to release and to hold harmless all of the persons or agencies mentioned above who (through negligence or carelessness) might otherwise be liable to me, my representatives, agents, assigns and heirs for damages. It is further understood and agreed that this waiver, release and assumption of risk is to be binding on me, my representatives, agents, assigns and heirs. In addition, I agree to indemnify and hold harmless Palm Springs Art Museum, its affiliates, and subsidiaries, employees, agents, officers and directors, and successors and assigns from and against all claims, damages, losses and expenses including attorney’s fees arising out of my participation in the Road Race as well as usage and enjoyment of the Road Race prizes, caused in whole or in part by my negligent act. I hereby grant Palm Springs Art Museum the absolute and irrevocable right and permission to use, reuse and publish all pictures taken of me. I fully understand that I hold no control over the use of the image of which I am a part. Further, I grant to Palm Springs Art Museum the right to use my name if necessary. I hereby release Palm Springs Art Museum from any and all claims and demands arising out of, or in connection with the use of the photograph, including any claims of libel. This authorization and release shall also apply to those working with or in connection with Palm Springs Art Museum as well as the person(s) who took the photograph. I HAVE CAREFULLY READ THE ABOVE RELEASE AND INDEMNITY AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND AGREEMENT TO INDEMNIFY PALM SPRINGS ART MUSEUM, AND I SIGN IT OF MY OWN FREE WILL.
