Logan Wells Memorial 5K

THIS IS A RUN/WALK EVENT ONLY – NO SKATEBOARDS, SCOOTERS OR BICYCLES PERMITTED ON THE COURSE PARTICIPANTS IN THE LOGAN WELLS MEMORIAL 5K & RELATED EVENTS (Activities) ARE REQUIRED TO ASSUME ALL RISK OF PARTICIPATION IN THE ACTIVITIES BY ACKNOWLEDING THIS GENERAL RELEASE AGREEMENT.. For Good and Valuable Consideration, including permission for the undersigned to participate in the Logan Wells Memorial 5K and related activities, The Logan Wells Memorial 5K, I, for myself, my successors, heirs, assigns, executors, and administrators, agree that prior to participating in the event I will inspect the facilities and equipment to be used therein and, if I believe any of them are unsafe, I will immediately advise the race officials or other supervisory personnel in attendance. I fully understand that I will be engaging in activities that involve risk of bodily injury or death, including economic losses, and which might result in my death or injury, as well as damages including medical and hospital bills, wage loss, temporary or permanent full or partial disability, and /or damage to my property, arising from my participation in the event. COST OF MEDICAL TREATMENT OR SERVICES The Athlete acknowledges and understands that medical personnel at the Activities are on standby at the Activities for the convenience of the Athletes and that any actual medical service or treatment that may be required in case of an emergency may result in a charge billable to the Athlete by the service organization, specifically the Yorba Linda Fire Department. Recognizing the foregoing, I nonetheless freely and voluntarily assume all risk of participation in the event. I hereby warrant, covenant, and agree to acquit, fully and forever release, relinquish, waive and discharge and promise to hold harmless, defend and indemnify the City of Yorba Linda, Placentia Yorba Linda Unified School District, County of Orange and their trails, State of California, The Logans Wells Memorial Foundation, Logan Wells Memorial 5K, USATF and their respective officers, directors, officials and organizers, employees, agents, volunteers, sponsors, medical personnel/volunteers and each and every affiliated entity from any and all liability, including claims for bodily injury, wrongful death, property damage, loss of consortium, of any nature or kind. The Athlete acknowledges that the ENTRY FEE IS NON-REFUNDABLE and NON-TRANSFERABLE. In the circumstance where any of the Activities are delayed or prevented by reason of fire, threatened or actual strike, labor difficulty, work stoppage, insurrection war, public disaster, flood, unavoidable casualty, acts of God or the elements (included without limitation, hurricanes, tornadoes, earthquakes) or any other cause beyond the control of The Logan Wells Memorial Foundation or Logan Wells Memorial 5K there shall be no refund of the entry fee or any other costs of the Athlete in connection with the Activities. I also warrant that I am in good health and have no physical condition that would prevent me from participating in the event. I HAVE READ THS WAIVER AND RELEASE, I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND NONETHELESS SIGN VOLUNTARILY. I agree that photographs, pictures, slides, movies or videos of me may be taken in connection with my participation in the event without compensation from the even sponsors, organizers beneficiaries or their permitees and further consent to the use of photographs, slides, movies or videos for any legal purpose.
