I, ____________________________, with an address of _________________________________ have registered to participate in the Mars Hill Mountain Challenge (the “Challenge”) which is scheduled for August 15, 2015. I certify that I am aware of all the potential dangers and risks associated with participation in the Challenge and I voluntarily accept and assume all risks in connection there with, including risks resulting from my own actions as well as the actions of others, including, but not limited to, other participants, event staff and spectators. The potential risks include, but are not limited to falls, illness, infection, contact with other participants, event staff or spectators, contact with obstacles, premises defects, and the effects of weather. In consideration of being allowed to participate in the Challenge, I hereby RELEASE, HOLD HARMLESS AND WAIVE ALL CLAIMS that I have or may have in the future against Bigrock Mountain, it’s officers, directors, employees, volunteers, insurers, venue, sponsors, contractors and assigns (herein after collectively referred to as the “Releasee”) for all loss, damage, injury or expense (including attorney fees) which I may suffer or sustain as a result of my participation or presence at the event, due to any cause whatsoever, whether foreseen or unforeseen; and further to save and hold harmless each Releasee from any claim by me, or my family, estate, heirs or assigns, arising out of my participation in the Challenge. I understand and acknowledge that all applicable rules for participation in the event, and all directions and instructions given by event staff, must be followed and the SOLE RESPONSIBILITY FOR Y PERSONAL SAFETY REMAINS WITH ME AT ALL TIMES while participating the event. I understand, accept and agree that some of obstacles go through water which may not have been tested for chemicals, disease or contamination. I agree not to dive into or enter any mud pits or water obstacles head first as doing so may result in serious injury to myself and/or others. I certify and affirm that I and have read this waiver in its entirety and agree with its terms. I understand and acknowledge that my participation in the Challenge is an inherently dangerous activity and that the risk of injury, serious injury or death, given that nature of the event, cannot be eliminated. I certify that I am physically fit and have no medical condition that would make my participation in the event more hazardous. I assume my own responsibility of physical fitness and capability to participate in the Challenge. I undertake and agree to remove myself from participation in the event should I sense or observe and hazard or unsafe condition, or feel unfit or unable to safely continue. ___________ Initials I consent to the use of my image photographs, motion pictures or recordings taken at the event, for use in event advertising, marketing or promotion. The undersigned expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Maine, and that if any portion is declared invalid, it is agreed that balance shall; notwithstanding, continue in full legal force and effect. I HAVE CAREFULLY READ AND UNDERSTOOD THIS WAIVER, RELEASE AND INDEMNITY and am aware that by signing this document, I am waiving substantial legal rights on my own behalf, and on behalf of my estate, heirs, executers and next of kin, including giving up the right to sue.
