RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT ("AGREEMENT") EVENT: SAN JACINTO FUN RUN 5K (formerly RUN UNITED 5K) (THE “EVENT”) FOR AND IN CONSIDERATION of being permitted to voluntarily participate in the "San Jacinto Fun Run 5K” on May 2, 2020, I, for myself, my personal representatives, assigns, heirs, and next of kin: 1. ACKNOWLEDGE, agree, and represent that my participation in the Event, as a participant in the 5K or as a volunteer or as a spectator, is voluntary and is independent of my employment (if employed by the Company and/or its affiliated entities). I further understand, agree, and acknowledge that I have elected to participate of my own accord, without coercion or duress. I further acknowledge, agree and represent that I will not receive any pay or remuneration of any kind for participation in the Event because it is a voluntary activity. 2. ACKNOWLEDGE, agree, and represent that I understand the nature of the Event and the physical and mental rigors associated with participating in a race, running, walking, and other related activities and events, and realize that running and other portions of this Event are inherently dangerous and may represent an extreme test of a person's physical and mental limits. I understand that participation in any portion of the event, whether as a participant, a volunteer or a spectator, involves risks and dangers which include, without limitation, the potential for serious bodily injury, sickness and disease, permanent disability, paralysis and loss of life; loss of or damage to equipment/property; exposure to extreme conditions and circumstances; accidents, contact or collision with other participants, spectators, vehicles or other natural or man made objects; dangers arising from adverse weather conditions; imperfect course conditions; water, road and surface hazards; equipment failure; inadequate safety measures; participants of varying skill levels; situations beyond the immediate control of the Company; and other undefined risks and dangers which may not be readily foreseeable or are presently unknown ("Risks"). I understand that these Risks may be caused in whole or in part by my own actions or inactions, the actions or inactions of others participating in the Event, or the acts, inaction or negligence of the Releasees defined below, and I hereby expressly assume all such Risks and responsibility for any damages, liabilities, losses or expenses which I incur as a result of my participation in the Event, and RELEASE Company and its agents and representatives for any and all liability arising out of my participating in this event. 3. ACKNOWLEDGE, agree and represent that (i) I am in good health and in proper physical condition to participate in the Event, or I am in proper physical condition to volunteer at the Event or be a spectator; and (ii) I am not under the influence of alcohol or any illicit or prescription drugs which would in any way impair my ability to safely participate in the Event. I agree that it is my sole responsibility to determine whether I am sufficiently fit and healthy enough to participate in the Event. If I am a participant, I certify that I am physically fit, have sufficiently trained for participation in the event and have not been advised otherwise by qualified medical personnel.
