ACCIDENT WAIVER & RELEASE OF LIABILITY
In consideration of you accepting this entry, I, the participant, intending to be legally bound and on behalf of myself, my executors, administrators, heirs, next of kin, successors, and assigns, hereby Waive, Release and Discharge from any and all liability for my death, disability, personal injury, property damage, property theft, and all rights and claims for damages or injuries that I may have against the City of Tulare; Event Director; Purple Pumpkin Ride for Rett Events; Scarlett Parks Foundation, and all their directors, officers, employees, volunteers, representatives and agents; event sponsors and their directors, officers, employees, volunteers representatives and agents in relation to my participation and attendance in the Metric Century, Mini Metric Century or the Family Fun Ride. This release includes all injuries and/or damages suffered by me before, during or after the event. I also authorize the use of photographs or videos that include my image and/or voice for promotional, informational, or other reasons deemed to be in the best interest of the event.
I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that my physical condition has been verified by a licensed Medical Doctor.
I am participating in the Metric Century, Mini Metric Century or the Family Fun Ride at my own risk and waive any and all claims of every nature against the City of Tulare, County of Tulare, City of Visalia, State of California Department of Transportation, California Highway Patrol, Scarlett Parks Foundation, Purple Pumpkin Ride for Rett Events, organizers, officials, sponsors, and any other participating agencies and their respective directors, officers, employees, volunteers, representatives and agents, with respect to any personal loss, illness, bodily injury or death resulting from participating in these activities. I fully understand the rigors of participation in an event such as this and have knowledge there are risks in bicycling and fully assume all such risks. I recognize part of this ride will be on roads which was not designed for bicyclists and there are hazards of which I must be mindful, including, but not limited to, uneven pavement, guard rails, signs, and drainage grates. Additionally, I recognize I must stay within the designated area of the vehicle travel lanes while on designated routes and obey all directions of the organizer, the California Department of Transportation, and the California Highway Patrol. I understand if I move outside of the designated areas, I will be removed from the ride and there will be no refund. Should an emergency vehicle need to pass through event participants on the freeway during the event, I will move to the fast lane of the freeway and allow the emergency vehicle to pass on the outside shoulder. The fast lane of the for this event is defined as the fast lane for motorists that would normally utilize the road. Should I need to leave the designated route early I can only do so in an officially marked Event SAG vehicle. If I have a maintenance or medical issue while on the freeway law enforcement and event SAG vehicles will be following the event participants. I have prepared myself physically for the bike ride. In participating in any ride event, I understand that I am required to wear a helmet and obey all traffic laws. At the time of registration, I will inform the ride officials regarding any relevant medical condition. I also understand that the majority of the Purple Pumpkin Ride for Rett is held on open roads that include vehicles, other cyclists, potential construction zones and possible livestock. I realize that the Purple Pumpkin Ride for Rett has limited control and I agree to follow the rules which govern cycling. I UNDERSTAND THAT I MUST HAVE CROSSED THE START LINE NO LATER THAN 7:05AM AND IF I DON’T I WILL NOT BE ALLOWED TO PROCEED TO ANY OF THE ROUTES AND I ALSO UNDERSTAND THEIR WILL BE NO-REFUNDS.
For all participants:
I agree and understand if I allow my bib number to be transferred to another person for any reason that I will personally contact the event Director which is found on the contact page of the website to inform the event of the new participant. I UNDERSTAND BY ALLOWING ANYONE TO USE MY BIB WITHOUT NOTIFYING THE RACE IN WRITING WILL CAUSE MY BIB TO BE INVALID WITH NO REFUND AND WILL CAUSE MYSELF TO BE BANNED FROM ALL FUTURE EVENTS RUN BY THIS ORGANIZATION.
I understand that the event will be held rain or shine and that there are NO REFUNDS, full or partial, for any reason. By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above waiver.
I hereby consent to receive medical treatment that may be deemed advisable in the event of injury, accident, and/or illness during this event.
The Accident Waiver & Release of Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I hereby certify that I have read this document; and I understand its contents.
