Read this Acknowledgement of Risk and Waiver of Liability carefully and in its entirety. It is a binding legal document. Acknowledgment: I understand that participating in the Italian Home for Children (“IHC”) 5K Run/Walk is a potentially hazardous activity and I should not enter and participate unless I am medically able and properly trained. I acknowledge and assume all risks associated with this event including, but not limited to, traffic on the course route, falls, contact with other participants, and the condition of the course, including, but not limited to, curbs, cars, uneven pavement, potholes, rocks, and objects on the course surface. Knowing and appreciating these risks and in consideration of your acceptance of my entry, I, for myself, and on behalf of my spouse, my heirs and next of kin, and any legal and personal representatives, or anyone else claiming on my behalf, covenant not to sue, and waive, release, and discharge and indemnify and hold harmless Italian Home for Children, Inc., the event organizers and promotors, race directors, sponsors, advertisers, , officers, directors, partners, shareholders, members, agents, employees, and volunteers, and anyone else acting for or on behalf the IHC 5K Run/Walk (Individually and collectively the “Released Parties”) with respect to any liability, claim, demand, cause of action, damages or loss or expenses (including court costs and reasonable attorney fees) of any kind or nature (“Liability”) which may arise out of, result from, or related to my participation in the Event, including claims for liability causes in whole or in party by the negligence of the Released Parties. I further agree that if, despite this Agreement, I or anyone on my behalf makes a claim for liability against any of the Released Parties, I will indemnify, defend and hold harmless each of the Released Parties form any such liability which may be incurred as a result of such claim. Consents: • I give permission to IHC and/or any person to use my name, age, finish place and finish time in the public domain. • I give permission to IHC to use any photographs, recordings, or any other record of this event for any purpose. In signing the Acknowledgement of Risk and Waiver Liability I hereby acknowledge and represent: (a) that I have read this document in its entirety, understand it, and sign it voluntarily; and (b) that this Acknowledgement of Risk and Waiver of Liability is the entire agreement between the parties hereto and its terms are contractual and not a mere recital.
