I hereby request the opportunity to participate in activities sponsored by the Board of Library Trustees in the Town of Dedham. I understand that each person, including myself, has a different capacity to participate in activities. I have familiarized myself with the nature and extent of the planned activities and am aware of the inherent hazards and the risk of injury of the activity/sport/program. I certify that I am in good physical condition and am able to safely participate in this activity/sport/program. I acknowledge that my voluntary participation in these programs and use of related equipment may expose me to risks of personal injury or death resulting from such participation and the use of materials and equipment by me and other participants. I THEREFORE ASSUME all risks and hazards incidental to such participation, including transportation to and from activities. I AGREE to indemnify, hold harmless, reimburse, and forever release the Town of Dedham, and all their employees, agents, board members, volunteers and any or all individuals and organizations assisting, sponsoring, or participating in recreation activities of the Town of Dedham (“the Releasees”) from any and all claims, rights of action and causes of action that may have arisen in the past, or may arise in the future, directly or indirectly, from personal injuries to myself or property damage resulting from my participation in a Town of Board of Library Trustees activity/item. I further acknowledge that my voluntary participation in these programs may result in my exposure to harm such as may be presented by, but not limited to, the COVID-19 virus or other sources of contagion through contact with other participants or members of the public. I am aware and acknowledge that the novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization, is extremely contagious, and is believed to be spread mainly from person-to-person contact. I acknowledge that the Town cannot guarantee that the participant or I will not become infected with COVID-19, and I acknowledge that attending any program may increase my risk of contracting COVID-19. I AUTHORIZE the Dedham Board of Library Trustees to reasonable use of any and all images and statements of/by/about the participant during any part of a Dedham Public Library activity for promotional purposes, including on the internet. I AFFIRM that I have read this Consent and Release, that I understand the contents, and that I am legally competent to sign this Consent and Release. I understand that my participation is voluntary and that I am free to choose not to participate in said activities. By signing this form, I affirm that I have decided to participate in the Town of Dedham’s Public Library activities and programs with full knowledge that the Releasees will not be liable to anyone for personal injuries and property damage that I may suffer during participation, and that I am participating in such activities at my own risk. The Town makes no warranties of any kind regarding the equipment used during such activities. I HAVE CAREFULLY READ AND FULLY UNDERSTAND THIS AGREEMENT, AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
