2018 Kids Triathlon

RESTON ASSOCIATION WAIVER Participant in Event/Athletic Event on Reston Facilities I hereby voluntarily register for the RA-Y Reston Kids Triathlon. I understand and acknowledge that the RA-Y Reston Kids Triathlon (“Activity”) is jointly sponsored and promoted by Reston Association and the YMCA of Metropolitan Washington, Reston Branch, (“YMCA”) and is sanctioned by USATriathlon. I expressly acknowledge that there are certain dangers, risks, illnesses, personal injuries and death inherent in participating in the Activity, which may result from falls, contact with other participants, the effects of weather, including high heat and/or humidity, traffic and the condition of the road, accidents or injuries, negligence of any person or organization, my attendance or participation in athletic activities, events, and programs, the use of any facilities and equipment, or from my or my minor child(ren)’s or ward(s)’ physical condition. I understand that the Reston Association and YMCA, and any other sponsors or organizers of the Activity and their employees, agents, counselors, teachers, trainers, representatives, successors and assigns assume no responsibility for loss, damage, illness or injury to person or property that I or my minor child(ren) or ward(s), if applicable, may sustain as a result of my or their physical condition or resulting from my or their participation in any activities, events or programs at or jointly sponsored by the Reston Association and YMCA. I hereby assume all risk and agree to accept full responsibility and liability for any damages or bodily injuries I or my child(ren) and ward(s), if applicable, may cause, sustain, or suffer arising out of participation in the above-referenced Activity, including any such damages or bodily injuries occurring during, resulting from, or related to any travel to or from the Activity. I am aware of the risks associated with participation in this Activity and hereby accept and assume on behalf of myself or dependent full responsibility for any and all such risks, including, without limitation, the need to check with a physician before engaging in this Activity, including any physical activity associated with this Activity. I understand that participation in this Activity may involve activities where injury can occur and shall be undertaken at my sole risk and expense. I hereby certify that I am physically fit and have not been otherwise informed by a physician. I understand that the Reston Association and YMCA do not employ physicians and that their staff cannot and do not diagnose medical conditions. I further represent that I and/or my minor child(ren) or ward(s)_currently have and carry health insurance and agree that any claim for medical treatment or other purposes shall be made against such health insurance and that my own or child(ren)’s or ward(s)’ own personal health insurance shall be primary insurance and the primary source of health insurance coverage in the event that I or my child(ren) or ward(s) sustain or suffer any bodily injury or medical crisis which participating in this Activity. In consideration of the Reston Association and YMCA allowing me and/or my minor child(ren) or ward(s) to attend and/or participate in any program, event, or other activity, including but not limited to, the Activity, jointly sponsored by the Reston Association and YMCA, I hereby, for myself, my minor child(ren) or ward(s), heirs, and executors, agree to waive, release and forever discharge the Reston Association and YMCA, their Boards of Directors and Managers, officers, employees, agents, volunteers, members, and their successors and assigns from any and all injuries, bodily injuries, costs, damages, causes of action, claims and any consequential and incidental damages arising out of or resulting from any injury, death, or damage to property which I or my minor child(ren) or ward(s) may sustain, suffer, or cause as a result of my participation or attendance in the above-referenced Activity, including any such injuries, costs, damages, causes of action, claims and any consequential and incidental damages occurring during, resulting from, or related to any travel to or from the Activity, whether or not such loss, damage, or injury results from the negligence of the Reston Association and/or YMCA and their employees, agents, or representatives or from some other cause. My agreement to release the Reston Association and YMCA does not include any loss, damage or injury that results from the Reston Association’s and/or YMCA’s gross negligence or willful, wanton, or reckless misconduct. I further agree to indemnify, reimburse, and forever hold harmless the Reston Association and YMCA, their Board of Directors and Managers, officers, employees, agents, volunteers, members, and their successors and assigns from any and all injuries, bodily injury, costs, damages, causes of action, claims and any consequential and incidental damages, including attorneys fees, arising out of or resulting from any injury, death, or damage to property which I or my minor child(ren) or ward(s) may sustain, suffer or cause as a result of attendance and/or participation in this Activity, including any such injuries, costs, damages, causes of action, claims and any consequential and incidental damages occurring during, resulting from, or related to any travel to or from the Activity. I hereby represent and warrant to the Reston Association and YMCA that I have the authority to execute this Participant Waiver Form on behalf of myself and/or on behalf of my minor child(ren) or ward(s) as parent, guardian and/or next friend, if applicable. In the event of any misrepresentation or breach of the foregoing warranty to me, or in the event that I, my minor child(ren) or ward(s), or any other person nevertheless asserts any claim against the Reston Association and/or YMCA arising out of my or my minor child(ren)’s or ward(s)’ attendance or participation in any activity, event or program as set forth herein, I agree to indemnify, hold harmless and defend the Reston Association and/or YMCA from and against any and all liability, claims, losses, costs, expenses or damages resulting therefrom, including but not limited to, claims of loss, damage, illness or injury to person or property whether or not such loss, damage, illness or injury results from the negligence of the Reston Association and/or YMCA. I acknowledge that I have read and voluntarily agree to the terms of this Indemnification and Waiver. If any portion of this Indemnification and Waiver shall be held invalid for any reason under the laws of the United States, Virginia, or Fairfax County, those parts that are not held invalid shall continue in full force and effect. In addition, I promise to abide by the rules and regulations adherent to this activity or event and to exercise care and caution for my personal safety and that of my fellow participants. I understand further that Reston’s pathways may have irregularities and I have familiarized myself with these conditions. Lastly, I also hereby grant permission for the sponsoring agencies, or appointed volunteers, to photograph and videotape me or my child and use such photographs and videotapes for promotional and advertising purposes and for trade purposes.
